In other words Hypomesus transpacificus is seemed to have a shorter life than the year of life expectancy originally god given to this fish (a smelt by any other name). This is just another example of the outrageousnous of the endangered species act.

Well a judge in California values the smelt more by ordering an impossible chore on a State agency.
State water officials are appealing a court decision that would have forced them to shut down the giant water pumps near Tracy that supply water to 25million Californians. This buys them time to change the way they operate so several threatened fish don't go extinct.At issue are the competing needs of water users from Stockton to San Jose to Southern California versus the ecosystem of the Delta, the West's largest estuary. California's population is rising, but the Delta is dying, at least in part because the pumps suck enormous amounts of fresh water out of its sloughs and canals.
The Department of Water Resources has operated the pumps for years knowing that it might be running afoul of state law, which requires anyone who accidentally kills threatened species – such as king salmon or Delta smelt – to get a special permit. The department had argued it was working roughly the same way as the nearby federal water pumps.
Yet not only had the agency never asked the state Department of Fish and Game for such a "consistency determination," but now the federal operating rules look likely to be tossed as well, thanks to a lawsuit similar to the one the DWR is appealing.
